Kannada History Taker — the same terms shown inside the application

Please read these Terms carefully. They govern your access to and use of this application.

1. Acceptance of Terms

1.1 These Terms and Conditions ("Terms") constitute a binding agreement between the developer of this application ("the Developer") and any person who accesses, installs or uses it ("the User").

1.2 By pressing "OK" and proceeding beyond this screen, the User acknowledges that they have read, understood and accepted these Terms in their entirety.

1.3 A User who does not accept these Terms must discontinue use and uninstall the application forthwith.

2. Nature and Purpose of the Application

2.1 This application ("the Application") is an educational aid. It provides a curated set of clinical history-taking questions in colloquial spoken Kannada, transliterated into the Roman script, together with their English meanings and illustrative patient responses.

2.2 The Application is intended solely to assist students of medicine in acquiring familiarity with the Kannada language as it is used in a clinical setting, and to complement, and not to replace, their formal instruction in clinical methods.

2.3 The Application is a conduit for learning and nothing more. It does not, in any manner or form, substitute the obligation of the User to learn the Kannada language. Every person residing in the State of Karnataka ought to learn Kannada, and the User acknowledges that no application can displace that obligation.

2.4 The Application does not teach clinical medicine, does not confer competence in history taking, and must not be treated as a source of clinical knowledge.

3. Permitted Use and Restrictions

3.1 THE APPLICATION IS PROVIDED FOR MEDICAL EDUCATIONAL PURPOSES ONLY AND SHALL NOT BE USED FOR ACTUAL THERAPEUTIC, DIAGNOSTIC OR INPATIENT HISTORY TAKING IN ANY CLINICAL SETTING WHATSOEVER.

3.2 Without limiting clause 3.1, the Application shall not be used, whether directly or indirectly, for:

3.2 (a) obtaining, recording or documenting a history from any patient for the purposes of diagnosis, treatment, referral or clinical decision-making;

3.2 (b) obtaining informed consent for any procedure, investigation, treatment, research study or transfer of care;

3.2 (c) the preparation of any case record, discharge summary, certificate, report or other document forming part of a patient's medical record;

3.2 (d) communication with a patient or attendant in any emergency, critical care or medico-legal situation; or

3.2 (e) any purpose for which a certified interpreter, a qualified translator or a fluent clinician is required.

3.3 The User shall at all times act within the supervision, curriculum, clinical governance framework and disciplinary rules of their institution, and nothing in the Application authorises any departure from them.

3.4 The Application is intended for students of medicine and allied health professionals. It is not intended for use by the general public, by patients, or by any person seeking information about their own health or that of another.

4. No Professional Relationship; No Medical Advice

4.1 Use of the Application creates no doctor-patient relationship, no teacher-student relationship and no professional relationship of any kind between the User and the Developer.

4.2 The content of the Application does not constitute medical advice, diagnosis, treatment or a recommendation of any kind, and must not be relied upon as such by any person.

5. No Interpretation or Translation Warranty

5.1 The Application is not a certified translation or interpretation service and has not been certified, validated or approved by any linguistic, academic, medical or regulatory authority.

5.2 The Kannada content reflects colloquial usage current in and around Bengaluru and Mysuru. Vocabulary, idiom and pronunciation vary materially across the regions of Karnataka and between urban and rural speakers, and a phrase intelligible to one patient may be unintelligible or misleading to another.

5.3 The transliteration scheme is phonetic and approximate, and is not a substitute for instruction in the Kannada script.

6. Accuracy, Errors and Feedback

6.1 The Application is not immune to error. Notwithstanding the best efforts of the Developer, the content may contain mistakes of language, transliteration, clinical emphasis, sequence or fact.

6.2 The Developer makes no representation that the content is complete, current, exhaustive or suited to any particular examination, institution, syllabus or patient population.

6.3 Users are strongly encouraged to report any error, ambiguity or unsafe phrasing to the Developer, so that it may be corrected for the benefit of all other Users.

6.4 Reports may be made through the contact channel notified within the Application. The Developer is under no obligation to act upon any report, to correct any error, to issue any update, or to continue making the Application available.

7. Patient Confidentiality and Data

7.2 The User shall not enter, record, photograph, transcribe or store within the Application, or in any note taken from it, any information by which a patient may be identified.

7.3 The User remains bound by all obligations of patient confidentiality imposed by law, by their institution and by professional regulation, and nothing in the Application dilutes those obligations.

8. Intellectual Property

8.1 All content within the Application, including its questions, translations, structure, arrangement, data files, source code and design, is the intellectual property of the Developer and is protected by applicable law.

8.2 The User is granted a limited, personal, non-exclusive, non-transferable and revocable licence to use the Application for their own study.

12.2 This limitation applies irrespective of the form of action, whether in contract, tort, negligence, strict liability or otherwise, and notwithstanding that the Developer may have been advised of the possibility of such loss.
